The Cyprus Commission for the Protection of Competition, at its meeting on the 19.09.2013, decided, as per Article 31 of the Protection of Competition Law (L.13(I)/2008), to conduct a dawn raid at the premises of GPM HENKEL LTD andfive retail stores which sell HENKEL’s products in the area of Nicosia.
The above investigation was conducted following a complaint submitted by Κ.Α.C Constantinides Trading Ltdagainst GPM Henkel Ltd for the alleged infringement of Article6(1) (a), (b) and (d) of the Protection of Competition Law (L.13(I)/2008), in relation to the fixing of unfair prices, restricting production or distribution of products to the detriment of consumers and making the conclusion of contracts subject to acceptance by other parties of supplementary obligations, which, by their nature or according to commercial usage, have no connection with the subject of such contracts.
The investigation began on the 19.09.2013 and was completed on the same day.
The Commission wishes to point out that the conduct of an investigation does not indicate by any means that anundertakingis guilty of an infringement of the Protection of Competition Law (L.13(I)/2008), but has as its aim to collect all information and evidence deemed necessary, as per the Commission’s powers of investigation for the implementation of the Law (L.13(I)/2008).
